Rezumat

The author analyzes the new settlements on the matter of effectuating the miscarriage: juridical-penal implications. The present study is exclusively centered on analyzing the legislature of republic of Moldova in the domain of abortion, on pointing out its imperfections and on offering suggestions for its improvement. To incriminate or not the deed of abortion, to displace on legislative way the beginning moment of a person’s life, to consider or not the fetus having the person capacity – all these depend on our society’s necessities for the moment. Any changes on this matter have to be based on well-grounded scientific investigations in the domain of penal law, criminology, sociology, psychology and others.
