REGLEMENTAREA RĂSPUNDERII PENALE PENTRU MONOPOLISMUL INFRACŢIONAL ÎN ŢĂRILE DIN SPAŢIUL CSI

Rezumat

The article represents a study on the settlement of penal responsibility for the criminal monopolism in the countries of the Commonwealth of Independent States (CIS). The penal laws of the post-Soviet countries can be grouped in two categories, if taking into consideration the formation method of the incriminations regarding the criminal monopolism. The penal norms regarding the mentioned offence, belonging to the legislative systems of Republic of Moldova, the Russian Federation, Azerbaijan Republic, Tajikistan Republic, Kazakhstan Republic, Kyrgyz Republic and Republic of Georgia, have major similarities and are created according to the example of art.265 “Monopolist actions and competition limitation” of the Model-Criminal Code of CIS. The second category is represented by the penal laws of Republic Belarus, Republic Uzbekistan and the Ukraine, which have a different inspiration, than the Model-Criminal Code of CIS. The author compares the stipulations of our Criminal Code with the Model-Criminal Code of CIS and the Criminal Codes of the CIS member states.
