Rezumat

The article represents an analysis of the social danger of the deeds committed in the field of entrepreneurial activity. The transition of Republic of Moldova to the new economic relations conditions the proliferations of the offences committed in the field of entrepreneurial activity. The entrepreneurial activity, the goal which is to create the gross national product, is one of the main sources of satisfying the social necessities and of growth of the state’s economic power. The author analyzes Moldova’s legislature in the domain mentioned above and compares it with the legislature of other countries. The penal policy, next to other policies referring to the entrepreneurial activity, should stimulate business people to “get out of the shadow”. Otherwise, the penal norms, destined to protect the entrepreneurial activity, will not function and all the attempts to apply them will have a reversed effect to the one expected by the society.
