Rezumat

The judicial nature of the offence’s product is analyzed in the present article. “The offence’s product” stands for the entity that appeared as such after the offence was committed, as a result of the criminal direct influence to which another entity (or more) was complied. The offence’s product does not confound with: the material object of the offence, the means of committing an offence, the good acquired through offence and other entities that relate to the criminal activity. The presence of the offence’s product is indispensable in that cases when the accusatorial provision contains wording like “falsification”, “manufacturing”, “fabrication”, “artificial creation”, etc.
