ASPECTE POLITICO-PENALE DE APLICARE A RĂSPUNDERII PENTRU MONOPOLISMUL INFRACŢIONAL

Rezumat

The political-penal aspects of applying the responsibility for the monopolism having the character of an offence are analyzed in the present article. Once the transition to the market economy started in Republic of Moldova, the national antimonopoly legislature that establishes the extra-penal responsibility for damages brought to competition appeared. Nevertheless, as the international and national practice demonstrates, the extra-penal antimonopoly settlements are not able to assure an efficient fighting against all monopolist manifestations. The author realizes a thorough analysis of articles 2451 and 246 of the Criminal Code of Republic of Moldova, which refer to the tackled problem.
