Rezumat

This article is concerned to the penal research of neonaticide according to the Criminal Code of Republic of
Moldova. Killing of the newborn child is considered to be a type of voluntary manslaughter committed with mitigating
circumstances only for the mother whose mental state was disturbed at the moment when crime was committed. The
Corpus Delicti of this criminal offence is analyzed. Some useful recommendations were suggested in order to improve
the process of interpretation of the certain crime.
