REGLEMENTAREA CONCEPTUALĂ A FUNCŢIEI PUBLICE ÎN ROMÂNIA ŞI ÎN REPUBLICA MOLDOVA

Rezumat
The analysis of the public post concept revealed that in Romania and Republic of Moldova, as well as in the member
states of the European Union, at the doctrinaire level, there is no definition unanimously accepted, this step being strongly
influenced by the traditions and force vectors of the public administration organization in each country.
From the legal definition of the concept, it results that the public post has its own characteristics. The civil service
could be defined as the juridical situation consisting of a complex of rights and obligations, legally determined, previewed
or allowed, through which it is fulfilled the competence of a public authority in regime of public power and in
accordance with the attributions of that authority.
