Abstract

In the present study there are examined the three template variants of offences and an aggravated variant of offense which are combined in art.1401 PC RM under same marginal definition of use, development, production, otherwise acquisition, processing, possession, storage or preservation, direct or indirect transfer, maintenance, transportation of weapons of mass destruction. There is shown the legal content of offenses specified at art.1401 PC RM. It is assessed the social danger of the offenses incriminated at art.1401 PC RM and the incrimination opportunity of the respective acts. Also, there are determined: the general legal object; the special legal object; the material or immaterial object (if applicable); the product (if applicable); the content of the prejudicial act (of action or inaction); the type of corpus delicti depending on the outcome of the offence (formal corpus delicti); the time of offense ending; the form and type of guilt; the motive; the qualities of the offense subject.
