RĂSPUNDEREA PENALĂ PENTRU INFRACŢIUNILE ÎN MATERIE DE ADOPŢIE (art.204 şi art.205 CP RM)

Rezumat

In the present investigation it is shown that in the offences against family cases, there can be distinguished the offences concerning adoption (art.204 and 205 PC RM). Namely the link of these acts to adoption - one of the institutions of Family Law - is what distinguishes them from the other offenses against family. As follows are analyzed the elements forming the offense of disclosure of the adoption secrecy, offense involving the disclosure of the adoption secrecy against the will of the adopter, committed by a person required to keep the adoption as a professional or work courtesy. There are also examined the constituent elements of the offences on parents or others abuse to the adoption of children, offenses involving three template variants and one aggravated variant.
