Rezumat

In the present study, there are subject to examination both offences affecting state or several international organizations authority, presented in some official insignia. As follows, it is established the degree of social danger of the offences at art.347 and 363 PC RM, as well as the opportunity of incrimination of the acts mentioned above. It is also determined the following: the legal generic object; the legal special object; the immaterial object; the content of the prejudicial act (action or inaction); the type of the offence composition regarding the offence outcome (formal structure); the moment of offence consumption; the form and type of guilt; the reason; the states of the subject of the offence. Finally, there are revealed the distinction criteria between the offenses mentioned at art.363 and 392 PC RM.
