THE OFFENSES PORTRAYED IN ART.173-1751 PC RM THROUGH THE VIEW OF THE LATEST AMENDMENTS IN THE PENAL LAW

Abstract

This article is dedicated to the penal law analysis of the offenses referred to in art.173 "Sexual Harassment", art.174 "Sexual intercourse with a person under the age of 16 years", art.175 "Perverse actions" and art.1751 "Approaching children for sexual purposes" of the Penal Code. The analysis is performed in terms of operation - on 12.04.2012 and on 26.12.2012 – of some amendments in the penal law. Of particular interest are the constituent elements of the offences specified in art.175 and 1751 PC RM. On all four criminal acts considered, there is made an important specification, that, if committing the acts in question is possible due to negligence at work (for example, not performing effective prevention measures) by a public person, that person is to be held liable under art.329 PC RM.
