GENERAL CONSIDERATIONS ON THE PRINCIPLE OF THE PROTECTION OF PROFESSIONAL SECRECY

Abstract

This publication is devoted to the analysis of aspects relating to the principle of the protection of professional secrecy, which also appears under the name “the principle of ensuring the confidentiality of the information received”.
The investigation continues with the analysis of the regulations of national, European legislation on the doctrinal background and judicial practice related to the procedural dimensions of the realization of the principle of protection of professional secrecy.
It shall be demonstrated that the bailiff, the staff employed by him or other persons participating in enforcement activities are obliged to maintain the confidentiality of information and facts which have become known to them in the enforcement proceedings.
