Аннотация

In the digital age, smuggling of migrants and illegal recruitment are becoming increasingly complex issues.

This article examines how digital technology influences these issues and proposes the reconceptualization of the crime of organizing illegal migration in the Republic of Moldova to include elements of human trafficking, in accordance with the TIM Protocol. In the Republic of Moldova, legislation needs to adapt to effectively combat these crimes in the digital environment while ensuring the protection of migrants’ rights. Additionally, it highlights the distinction between smuggling of migrant and human trafficking, emphasizing the need for separate legislative approaches. International cooperation and victim protection are also discussed as crucial aspects for the develop- ment of a comprehensive legal framework. The conclusion underscores the importance of legislative adaptation to prevent and combat migrant trafficking and illegal recruitment in the digital era, ensuring a safer environment for migrants.
