STATUS OF SURVIVING SPOUSE BEFORE AND AFTER THE MODERNIZATION OF THE CIVIL CODE OF THE REPUBLIC OF MOLDOVA

Rezumat

The present article deals with the problems arising from the change in the status of the surviving spouse after the
modernization of the Civil Code of the Republic of Moldova. It is shown that the compulsory share in inheritance
serves as one of the mechanisms of legal protection of the family, providing a guaranteed share of inherited property.
Special attention is paid to the size of the compulsory share of the surviving spouse after the modernization of the
Civil Code of the Republic of Moldova. The author analyzes the content of the status of the surviving spouse before
and after the modernization of the Civil Code, the peculiarities of the size of the compulsory share depending on the
order of competing heirs. Foreign forms of family protection are analyzed. The possibility of borrowing European
forms of protection into Moldovan legislation is studied. The author comes to the conclusion that it is necessary to
establish different criteria allowing to change the size of the compulsory share.
