THE CONCEPT OF AN ENTERPRISE:LEGAL DEFINITIONS AND SCIENTIFIC INTERPRETATIONS (THE PROBLEM OF PERSONIFICATION OF AN ENTERPRISE)

Rezumat
This article examines the ambiguity of the legal term “enterprise” and its scientific interpretations. The article explores the interpretation of the term “enterprise” not only under Moldovan law but also using examples from other countries. Particular attention is paid to trends and doctrines of the personification of enterprises, that is, the identification of an enterprise as an economic phenomenon with a legal entity. The problem of enterprise personification is examined using the paradoxical theory of Soviet civil law regarding enterprises and legal entities as an example. An example of direct enterprise personification in modern Ukrainian economic law and in the theory of modern Russian business (economic) law as an independent field is given. Further methodological directions for studying the phenomenon of enterprise from the perspective of business law are proposed.
